The Industrial Property Board of Appeal acknowledges reputation of "JACK DANIEL'S" marks; invalidates the contested mark "BLACK JACK FOR ALL"

Our client JACK DANIEL’S PROPERTIES, INC. in 2019 filed an opposition against the international registration “BLACK JACK FOR ALL” designating Latvia  (No. WO 1418720). The opposition was filed against goods in class 33.

The opposition was based on detrminent to the reputed marks “JACK DANIEL’S” and likelihood of confusion between the marks “BLACK JACK FOR ALL”  and “JACK DANIEL’S”. This case was handled by the trademark and design attorney, lawyer Kristīne Ostrovska.

The Industrial Property Board of Appeal in the decision of 17 October, 2020 admitted the opposition as well-reasoned and decided to invalidate the mark “BLACK JACK FOR ALL” in Latvia. The Board of Appeal established the reputation of the earlier EUTMs No. 011337359  and EUTM No. 002744829  with respect to goods in class 33 – alcoholic beverages, namely, whiskey.
